Definitions
(a) The ‘Lessee’ is the person entering a rental agreement with CampSetGo, and whose name appears at the head of the booking form. The lessee accepts full legal liability for all the rented equipment.
(b) The rental equipment includes but is not limited to tents, air beds, sleeping bags, sheets, towels, hammers, pegs and lines, cooking utensils, cutlery, plates and cups, pots and pans, cooking tables, coolers, tables, chairs, groundsheets, power cables, surfboards, hammocks, sleeves and bags, lamps and all other matters of which reasonably may be expected to be connected with the rented.
(c) ‘In writing’ also includes email.
Reservation
(a) The reservation must be made at least 72 hours before the rental period.
(b) The lessee must be 21 years or older.
Confirmation
(a) The lease will be confirmed by CampSetGo by email if and when the reservation is made by lessee and when the payment due is fully received by CampSetGo.
(b) The written confirmation by CampSetGo shall be deemed to correctly and completely display the content of the agreement. Lessee shall be deemed to agree with the contents of the written confirmation, unless lessee announces in writing to CampSetGo that he cannot agree with the content within 72 hours after the date of the written confirmation.
(c) CampSetGo reserves the right to refuse service to anyone..
The rental period
(a) The minimum rental period is 3 nights.
(b) The rental period starts at the agreed time of delivery, if the rental equipment is not picked up by lessee for whatever reason, the rent is nevertheless due as of that date.
(c) The rental period ends at the agreed time of return of the rental equipment. If the rental equipment has been returned before the end of the agreed rental period, no refund will be given for the remaining period of the agreement.
(d) The rental period can be extended beyond the initially agreed upon period only after the lessee has received full written agreement to do so from CampSetGo.
Payment and deposit
(a) The payment done by the lessee at the time of the booking includes current VAT and any eventual obligatory taxes. The deposit will be added to the payment when selecting the rental equipment during the booking procedure and varies depending on the amount and type of rental equipment.
(b) If the condition of all rented equipment is in good order after return, the deposit will be returned to the lessee’s bank account within 72 hours. If the rental equipment is damaged or not complete or if the conditions have not been met, CampSetGo can withhold part of the amount of the deposit. In this case, CampSetGo will inform the lessee within 48 hours in writing.
Cancellation
(a) If lessee wants to cancel the booking, lessee has to do so in writing to CampSetGo. The date the written cancellation is received by CampSetGo is regarded as the cancellation date.
(b) Cancellation up until 14 days before the rental period is free of charge.
(c) Cancellation of the rental equipment 14 to 7 days before the rental period will result in a 50% refund.
(d) Cancellation of the rental equipment 7 to 3 days before the rental period will result in a 25% refund.
(e) In case of cancellation done within 3 days before the rental period there will be no refund.
(f) In all cases of cancellation the deposit will be returned to the lessee’s bank account.
(g) In any case of cancellation CampSetGo will make relevant payment to the lessee’s bank account within 72 hours after having received the cancellation.
(h) If the rental equipment has not been picked up within 48 hours of the agreed delivery time, CampSetGo will regard this as a cancellation as described in (e) and will make the rental equipment available for new rentals.
Delivery
(a) Delivery occurs at the agreed time and place. Lessee will check if the rental equipment is complete and in good order.
(b) In any case of defects of the rental equipment, lessee will inform CampSetGo in writing within 24 hours.
(c) The lessee accepts full responsibility for the safe use of the rental equipment and the safety of any person who makes use of the rental equipment for the duration of the rental period.
Liability
(a) It is the responsibility of the lessee to ensure that there is no loss or damage to the rental equipment or personal injury to themselves or third parties. CampSetGo accepts no liability for loss or damage to personal possessions or injury or death to the lessee or third parties who use the rental equipment.
(b) During the rental period CampSetGo is in no way responsible for:
Damage and/or injury to persons or environment caused by improper use of the rental equipment or by any other cause.
Loss, theft or damage of personal belongings or money.
Loss of travel and holiday enjoyment, business or other damages.
Any damages to third parties.
(c) In the unlikely event that the equipment is damaged by the previous lessee and that no suitable alternative can be found, a full refund will be issued. However, CampSetGo accepts no further liability.
Use of equipment
(a) All rental equipment is the property of CampSetGo. The lessee must not hire out the rental equipment to any third party.
(b) Before use, lessee must read the terms of use of the rental equipment and all supplied manuals and user instructions carefully and to comply with them.
(c) Lessee is not allowed to make changes or alterations to the rental equipment.
(d) The name tags of CampSetGo must not be removed from the rental equipment.
(e) It is the lessee’s responsibility to check, at all times, that all pegs are securely fastened and that all ropes are secure.
(d) Smoking is not allowed in the tents.
(e) Pets are not allowed.
Return of equipment
(a) The rental equipment must be returned undamaged and in the same condition as delivered, dry and free from excessive dirt. All cooking equipment must be returned fully cleansed.
(b) The rental equipment will be returned by lessee at the time and location agreed with CampSetGo.
(c) If the rental equipment is not returned by lessee at the time and location agreed with CampSetGo, without any prior written permission by CampSetGo, CampSetGo has the right to claim the entire deposit.
(d) Any alterations to the rental period, delivery or return time or location can be made only in full written agreement between CampSetGo and lessee.
(e) In the case of theft, loss or total loss caused by destruction or any other form of damage, lessee has to pay the full purchase price of the rental equipment on the basis of CampSetGo’s current purchase prices.
Damage
(a) Lessee will report loss or damage to the rental equipment to CampSetGo immediately upon discovery or within a maximum of 24 hours, in writing.
(b) Lessee should not attempt to use damaged equipment.
(c) If CampSetGo finds the damage to impede the usability or safety of the rental equipment, arrangements will be made to repair or replace the rental equipment.
(d) In the event of theft of the rental equipment lessee is obliged to report this to CampSetGo immediately upon discovery, to report the theft at the local police station and to hand over (a copy of) the declaration to CampSetGo.
(e) Charges will be made for the damage of the rental equipment during the rental period. The charge will not be greater than the total cost of a replacement tent or a specific item. If the amount to be charged is greater than the value of the deposit, the lessee agrees to pay for all the costs incurred in repairing/replacing the equipment minus the paid deposit.
(f) Damage to the rental equipment includes: loss, theft and all other costs for replacement or repair to be made by CampSetGo to bring the rental equipment to its original state, as judged by CampSetGo.
(g) When the rental equipment is returned to CampSetGo excessively dirty (e.g. mud, stains), or with excessive odours (e.g. cigarettes), the amount that is required to restore the rental equipment to its original state will be charged to lessee.
Travel Insurance
(a) It is highly advisable to have a travel insurance or a liability insurance during the rental period, for the payment of the damages that might occur during the rental period.
Final words
(a) If more than one person occurs as a lessee, then each lessee will be liable for the payment and obligations arising from this agreement and the terms of use. The total liability shall not exceed the amount arising from the agreement and the terms of use.
(b) CampSetGo is in no way responsible for lessee making the wrong choice in size regarding rental cars.
(c) CampSetGo is not responsible for which choice is made for car rental insurance.
(d) CampSetGo reserves the right to make changes in the terms and conditions and to change the prices of the rental equipment on the website.
(d) This agreement is subject to Portuguese law and national and local regulations.
